Child Support
It is important that your children receive the financial support that they need. The state of Louisiana considers it the responsibility of both parents to support their children—regardless of whether a couple is divorced or were never married.
Our New Orleans child support lawyers at Thornhill & Collings, LC represent both mothers and fathers in the negotiation, modification, and enforcement of child support agreements in Southern Louisiana. We are here to protect your legal rights and the rights of your children.
Louisiana Child Support
Unless parents are able to reach a suitable child support agreement on their own, a Louisiana court will use the state’s child support guidelines to determine the amount of monthly support that each child should receive.
Louisiana’s child support guidelines apply the Income Shares Model to calculate the amount of financial support. To determine this amount, the gross income of both parents, any community property debts, spousal support payments, the number of children that need child support, any special or extraordinary needs affecting the child, and whether a parent has other dependents to support are taken into consideration. Louisiana child support usually lasts until the age of majority.
Calculating child support can be a complicated process and there may be exceptions to the guidelines, which are determined on a case-by-case basis. This is why it is so important that you are represented by an experienced child support attorney that has a thorough understanding of Louisiana’s child support laws and can make sure that your children receive the correct support payments.
Modification and Enforcement of Louisiana Child Support Orders
Sometimes, modifications to a Louisiana court-approved child support order is necessary, such as when one parent becomes unemployed or another parent gets a higher or lower paying job.
If you believe that an increase in child support is warranted, one of our child custody lawyers can petition the court to request a modification to your existing child support order. If you would like to defend against a Louisiana child support modification petition, Thornhill & Collings, LC can protect your rights and enforce the existing child support agreement. If your spouse refuses to pay the court-ordered child support, we can take the necessary steps to enforce the child support order and collect late payments.
